Maryland lawmakers propose HB 1250 to regulate chatbots, emphasizing consumer data protection while addressing concerns over local government operational impacts.

On March 3, Legislative Services Assistant Charlotte Fleckenstein testified on behalf of Karrington Anderson before the Economic Matters Committee, advocating for HB 1250 – Consumer Protection and Product Liability – Chatbots, with amendments. The proposed legislation seeks to establish regulations governing chatbots, addressing critical areas such as data safety and privacy protections, display warning requirements, monthly reporting obligations, data portability, and data retention.

As the use of artificial intelligence tools continues to expand across both the private and public sectors, lawmakers are grappling with the challenge of formulating effective regulations that ensure safety without hindering innovation. Local governments have expressed support for robust consumer data protections but have raised concerns regarding potential unintended consequences of the legislation on their operations.

Counties increasingly utilize AI-driven systems to enhance their non-emergency services, such as 3-1-1 and 9-1-1, thereby improving response times and streamlining routine service requests. While the bill’s mandates for transparency and reporting may be suitable for commercial chatbot platforms, applying the same framework to internal government operations could impose significant administrative burdens, escalate costs, and delay the implementation of critical technologies that bolster public safety and essential services. The Maryland Association of Counties (MACo) has proposed amendments aimed at preserving consumer protections while enabling local governments to adapt their operations in a responsible and efficient manner.

“While MACo appreciates the intent to protect consumer privacy and safety in the age of generative AI, the bill creates significant operational risks for local government public safety systems and essential internal operations,” the organization stated. “MACo supports reasonable, consumer-focused guardrails for commercial AI tools operating in the public marketplace.”

This legislative discussion occurs amid a broader conversation about the implications of rapidly evolving AI technologies and their integration into everyday life. With AI increasingly embedded in various sectors, the call for regulatory clarity is becoming ever more urgent, as stakeholders from different areas seek to find a balance between innovation and responsibility.
