This decision comes amid growing concerns from board members regarding trees encroaching into the Runway 27 approach surface, which could pose safety risks for aircraft during landing.

According to project staff member Paul, the proposed project primarily affects two larger parcels of land, which collectively cover approximately 30 acres, along with several smaller parcels. The pre-application serves as a placeholder to notify the FAA of the city’s intentions and to secure funding for essential services such as appraisals, title work, surveying, and negotiation with landowners. Paul emphasized that this pre-application does not obligate the city to acquire land outright; instead, it initiates the usual appraisal process to determine easement values before any negotiations commence.

As part of the FAA’s guidelines, Paul noted the importance of adhering to the Part-77 surface approach slope, which is set at a ratio of 50:1. This guideline establishes the necessary vertical clearance for the approach, which will be regulated through navigation easements. These easements would be designed to be perpetual and funded by the airport, although property owners may opt to sell fee simple titles instead. In such cases, negotiations would focus on establishing fair compensation for the land involved.

The board’s unanimous approval of the pre-application allows staff to move forward in scoping the required professional services and continuing discussions with affected landowners. Paul pointed out that the FAA pre-application deadline is set for December 1, highlighting the urgency of the next steps.

In the coming weeks, the focus will shift to prioritizing negotiations with the two larger parcels located along the runway centerline. Coordination with city staff and legal counsel will also be essential in developing appraisals and drafting easement language. This proactive approach aims not only to address immediate concerns related to the Runway 27 approach but also to enhance safety and operational efficiency at Elkhart City Airport.
