UK Regulators Shift Focus: Promoting AI Innovation Over Enforcement in New Action Plan

UK regulators, led by the CMA and ICO, prioritize fostering AI innovation through regulatory sandboxes while addressing competition concerns and public safety.

The regulation of artificial intelligence (AI) in the UK, often perceived as trailing the European Union, is evolving into a distinct sectoral framework. Instead of establishing a centralized AI authority, the UK government is delegating AI oversight to existing regulators, creating a multifaceted regulatory landscape. This approach, outlined in March 2023 by the Conservative government’s AI White Paper, emphasizes the adaptability of sector regulators in monitoring AI’s impact across various industries.

This regulatory model has gained further traction under the Labour government, which, while not overturning the prior framework, has shifted its focus towards fostering AI innovation within sectors. Baroness Lloyd, a minister for the Department for Science, Innovation & Technology, emphasized that existing regulators are already equipped to manage AI through a context-specific approach. She noted the establishment of initiatives like regulatory sandboxes and the proposed AI growth lab, which aims to encourage collaboration among regulators in response to rapidly evolving technological advancements.

Despite this framework, challenges persist, particularly as foundational AI models transcend sector boundaries. Some regulators, such as the Competition and Markets Authority (CMA), have actively engaged with AI oversight, whereas others like the Information Commissioner’s Office (ICO) and the Financial Conduct Authority (FCA) have primarily issued guidance without moving towards enforcement actions. The Digital Regulation Cooperation Forum (DRCF), a collaboration of four key UK regulators, is examining emerging AI applications, including agentic AI, which introduces new risks that require careful consideration.

The CMA has been at the forefront of AI regulation, advocating for a principles-based approach. In July 2024, the CMA, alongside international counterparts, issued a statement addressing concerns over competition in generative AI foundation models and the risks associated with concentrated market power. The CMA has initiated multiple merger control investigations, notably into partnerships involving major tech firms like Microsoft and Amazon, examining whether these transactions could reduce competition in the AI market.

On the other hand, the ICO’s strategy, “Preventing Harm, Promoting Trust,” aims to strike a balance between AI development and individual safety. It focuses on ensuring that organizations deploying AI technologies adhere to data protection standards. The ICO’s initiatives include consulting on updated guidance for automated decision-making, scrutinizing foundation model developers, and assessing the implications of agentic AI on data protection. Their regulatory sandboxes are testing emerging technologies, including those related to AI, to ensure compliance and promote safe innovation.

The FCA has adopted a more lenient stance, emphasizing a technology-agnostic, principles-based approach without imposing new AI-specific regulations. The FCA’s chief executive, Nikhil Rathi, indicated that the regulator would not penalize firms for minor issues with their AI innovations, instead focusing on significant failures. This approach is complemented by initiatives like the “supercharged sandbox,” which provides early-stage firms access to regulatory support and data necessary for responsible AI deployment.

In telecommunications, OFCOM has issued guidance clarifying that existing regulatory frameworks apply to AI-enabled services, particularly in online safety. It has taken enforcement actions under the Online Safety Act against non-compliant operators while exploring the implications of AI through its strategic approach. OFCOM is collaborating with other regulators to deepen its understanding of AI’s risks and opportunities, particularly in the context of emerging technologies.

In the energy sector, OFGEM has released additional guidance focused on ethical AI deployment. It aims to harness AI’s potential while mitigating associated risks through consultations and technical sandboxes. The Medicines and Healthcare products Regulatory Agency (MHRA) is also reviewing regulations governing AI as a medical device, seeking to streamline processes while ensuring safety and efficacy in AI applications in healthcare.

The Advertising Standards Authority (ASA) has provided guidance on the ethical use of AI in advertising, urging advertisers to avoid misleading claims about AI capabilities. Similarly, the Gambling Commission has issued guidance related to AI’s role in ensuring compliance with anti-money laundering regulations, emphasizing the importance of robust oversight in gambling operations.

While the Civil Aviation Authority (CAA) has made some advancements in enabling AI innovation through sandboxes, it has not yet established comprehensive regulatory frameworks specific to the aviation sector. This contrasts with the EU’s more developed stance on AI use in aviation, highlighting the UK’s ongoing regulatory evolution.

As the UK continues to navigate the complexities of AI regulation, the role of various sector regulators will be pivotal in shaping a balanced approach that promotes innovation while safeguarding public interests. The path forward will require a collaborative effort among regulators, industry stakeholders, and lawmakers to ensure effective oversight in this rapidly advancing technological landscape.
