In a significant move, the FTC launched enforcement sweeps aimed at identifying and curbing deceptive claims associated with AI tools. The agency also initiated an inquiry in 2025 focused on companies marketing AI chatbots as “companions,” seeking clarity on how these firms monitor and mitigate potential risks to users, particularly children and teenagers.

As businesses consider deploying AI chatbots, understanding the legal landscape and implementing practical safeguards are imperative. The risks associated with internal and customer-facing chatbots differ significantly. Internal chatbots, primarily used by employees to navigate internal policies, face risks such as exposing confidential information and potential employee monitoring through chat logs. Conversely, customer-facing chatbots, which interact directly with users, can mislead customers with inaccurate product information and may violate state privacy laws, particularly if they engage with minors or vulnerable populations.

Both types of chatbots necessitate protective measures, but the stakes are higher for public-facing bots, which require rigorous disclaimers, monitoring systems, and clearly defined escalation paths. Companies must be vigilant about the kind of information their chatbots disseminate. Misleading or exaggerated claims, like those promising “guaranteed accuracy” or “certified financial advice,” could lead to accusations of deceptive practices under federal and state consumer protection laws. The FTC has signaled its intent to scrutinize how businesses market and deploy these AI tools, putting additional pressure on companies to ensure compliance.

Security remains a paramount concern as well; vulnerabilities such as prompt injection and social engineering tactics through chatbots can pose significant risks to both companies and users.

Establishing effective disclaimers is a critical area for companies looking to cultivate a defensible risk posture. Disclaimers should clarify the nature of the service, define the limits of accuracy, and advise users not to rely on chatbots for emergencies or professional advice. The FTC expects disclosure to be prominent and conspicuous, avoiding “dark patterns” where important information is buried in fine print.

Best practices suggest placing a clear, straightforward notice adjacent to the chat interface and reiterating key points in the chatbot’s initial automated message. Companies should also require user acceptance of terms before engaging with the chatbot, ensuring that privacy policies and data use disclosures are readily accessible.

Before launching a chatbot, businesses should implement comprehensive governance frameworks. This includes internal AI use policies, vendor contracts addressing data processing obligations and security standards, and ongoing testing for accuracy and safety. Regular monitoring and audits of chat logs are also vital to adapt to real-world usage and regulatory expectations.

As AI chatbots become more prevalent, the imperative for thoughtful deployment and adherence to legal standards grows. Companies must navigate these challenges with vigilance, balancing innovation with the need for transparency and consumer protection. The future landscape of AI chatbots will likely evolve, influenced by ongoing regulatory scrutiny and societal expectations regarding data privacy and ethical use.
