South Korea is refining its AI Basic Act less than three months after its implementation on January 22, 2026. The government has initiated a public-private task force that includes over 40 experts from industry, academia, and civil society. This initiative coincides with ministries enhancing policy briefings and establishing direct consultation channels with startups, signaling a transition into a new phase of the law where policy is shaped by real-world applications rather than solely through enforcement.
The “AI Basic Act Institutional Improvement Task Force” will identify gaps during a one-year grace period and translate these insights into concrete policy adjustments. This process emphasizes structured discussions that encompass legal, industrial, and civil society perspectives, marking a shift toward what can be termed a calibration phase. Policy is evolving based on deployment feedback, stakeholder input, and institutional coordination.
Jung Woo-joo, CEO of inDJ and a member of the Presidential Committee on Artificial Intelligence Strategy, explained in a written interview that the law was crafted with inherent flexibility. “We deliberately chose a ‘post-regulation’ approach for general-purpose AI while focusing on ‘pre-emptive safety’ for high-impact areas, allowing startups the breathing room to experiment while maintaining a social safety net,” he stated. This design encourages broad experimentation while introducing safeguards in critical sectors like healthcare and public systems.
However, once AI systems are deployed in real environments, new pressures arise. Ashley Reeves, CEO of ArbaLabs, emphasized that technical capability is often not the decisive factor in regulated environments. “What really determines whether conversations move forward is whether people believe you understand the consequences of deployment, failure modes, misuse, and long-term responsibility,” she said. This reflects a fundamental shift where trust must be demonstrated through traceability, accountability, and operational discipline.
Michael Hwang, Vice President at SelectStar (Datumo), further illustrated how this pressure intensifies in sectors like telecom AI, where reliability involves more than general helpfulness. “Reliability in telecom AI means more than general helpfulness; it requires consistent, safe behavior under edge cases, robust guardrails, and auditable, repeatable governance,” he remarked. Such operational realities reveal gaps that cannot be addressed solely through pre-defined regulations; they necessitate ongoing refinement.
The task force does not aim to rewrite the law but rather refine its practical application. Current discussions likely focus on several areas, including the interpretation of “high-impact AI,” transparency and explainability requirements, practical compliance pathways for startups, technical expectations for auditability and governance, and alignment between legal definitions and real deployment conditions. The task force’s structure, which separates academic/legal, industry, and civil society groups, suggests a move toward more granular, sector-specific standards.
The one-year grace period embedded in the AI Basic Act is functioning as a policy testing ground, enabling the government to actively gather feedback through briefings, consultations, and industry engagement. Additional briefing sessions are scheduled between April and August, featuring live Q&A and one-on-one consultations for startups. This indicates that the grace period serves as a controlled environment to test policy assumptions against real-world deployment.
Previously viewed as a regulatory burden, compliance is now being reframed as a form of global positioning. Jung Woo-joo described alignment with the law as obtaining a “Global Entry Ticket,” indicating that compliance is increasingly tied to market access, particularly in regulated sectors and international collaborations. Ashley Reeves reiterated this perspective, noting that demonstrating accountability is becoming a prerequisite for deployment in decentralized environments.
As such, the competitive advantage now lies with teams capable of building audit-ready systems, documenting model behavior and risks, engaging with regulators early, and adapting to evolving standards. Globally, different approaches to AI regulation are emerging, with the European Union adjusting its implementation timelines and the United States discussing a federal AI law amid state-level regulations. South Korea is carving out its model by combining early legal codification with iterative adjustments driven by industry participation and real-world feedback, positioning itself as an adaptive governance environment.
Despite the progress, challenges remain. Jung Woo-joo acknowledged that definitions like “high-impact AI” still require more granular guidance, and Michael Hwang highlighted the limitations of generic benchmarks in high-risk environments. As he noted, “telco-grade AI requires trustworthiness evaluations that go beyond generic benchmarks,” which includes structured adversarial testing and repeatable evaluation systems. The ongoing challenge is translating broad principles of trust, safety, and accountability into enforceable and testable standards across various sectors.
South Korea has moved beyond merely passing and enforcing its AI Basic Act; it is now being tested in real-world environments where policy, technology, and market expectations intersect. The effectiveness with which feedback from startups, industry, and technical operators can be translated into standards that foster innovation while maintaining trust will determine the next phase of this evolving landscape.
