The judge’s remarks were encapsulated in a two-sentence footnote, where she noted that the use of ChatGPT to generate these reports might be compromising the credibility of the agents involved. She referenced a specific incident involving body camera footage, in which an agent utilized ChatGPT to compile a narrative based on minimal input—a brief sentence and several images. This raised alarms about potential discrepancies between the reported narratives and the actual events as captured on video.
Experts in the field have criticized this approach, suggesting that using AI to create reports that rely on an officer’s subjective perspective, without incorporating their firsthand experience, represents a troubling application of technology. Ian Adams, an assistant criminology professor at the University of South Carolina, emphasized that such practices go against established guidelines for accurate reporting. “What this guy did is the worst of all worlds,” he stated. “It’s a nightmare scenario.” He pointed out that courts generally apply a standard of objective reasonableness when evaluating the justification for use-of-force actions, heavily relying on the specific experiences of the officers involved.
Concerns extend beyond just accuracy; they also touch upon privacy issues. Katie Kinsey, chief of staff and tech policy counsel at the Policing Project at NYU School of Law, noted that if the agent was employing a public version of ChatGPT, he likely lost control of the uploaded images, which could end up in the public domain and be exploited by malicious actors. Kinsey criticized law enforcement agencies for often reacting to technological developments post-factum, rather than implementing proactive guidelines. “You would rather do things the other way around, where you understand the risks and develop guardrails around the risks,” she remarked.

Adams pointed out that many departments prohibit the use of predictive AI for writing reports that justify law enforcement decisions, particularly those related to use of force. The AI tools being implemented in some police departments remain unproven. For instance, companies like Axon are marketing AI components with body cameras designed to assist in writing incident reports. However, these technologies primarily rely on audio from body cameras and avoid using visual data due to concerns about their reliability. Andrew Guthrie Ferguson, a law professor at George Washington University Law School, pointed out that describing visual elements through AI can lead to varied interpretations, complicating the accuracy of reports.
As law enforcement grapples with the integration of AI, questions around professionalism and the ethical implications of predictive analytics continue to arise. Ferguson questioned whether it is acceptable for police officers to rely on AI-generated narratives in critical situations. “It’s about what the model thinks should have happened, but might not be what actually happened,” he warned, emphasizing the risk of AI-generated content being used in court to justify law enforcement actions.
