The Turks and Caicos Islands Judiciary has been recognized as a pioneering force in the global legal landscape for its rapid and decisive regulation of generative artificial intelligence in court proceedings. This commendation comes from Mark A. Fulford, President of the Turks and Caicos Islands Bar Association, during his remarks at the opening of the Legal Year on January 6, 2025, at the Supreme Court Annex in Providenciales.
Fulford delivered a measured assessment of the justice system, balancing criticism of institutional pressures with accolades for the judiciary’s landmark innovations. He stated, “The opening of the legal year invites us not only to mark the passage of time but to reflect on the stewardship of justice in our jurisdiction.” This period, he noted, is one of accountability and a reaffirmation of the commitment to the rule of law underlying the constitutional democracy of the islands.
Addressing challenges faced by the Judiciary in the previous year, Fulford praised the leadership of the presiding judge. “On behalf of the Bar Association, I extend sincere appreciation to Your Ladyship for your leadership of the Judiciary throughout 2025,” he remarked, acknowledging the demanding nature of the judicial workload, which included heavy caseloads and heightened public scrutiny.
Fulford highlighted the necessity of recognizing the “full year” experienced by legal professionals, stating, “Members of the profession sometimes joke that we measure the year not by months, but by court lists and bundles.” He emphasized that it is crucial to reflect on the legal work conducted and the responsibilities carried by the Judiciary.
The Bar President credited the Judiciary for positioning the Turks and Caicos Islands as a leader in legal innovation. He pointed out its achievement as “the first in the world to adopt a Practice Direction governing the responsible use of generative artificial intelligence in court proceedings.” Fulford underscored that this initiative serves as a necessary safeguard rather than a mere technological novelty.
He elaborated, “This step was not about technology for its own sake, but about safeguarding fairness, transparency, and integrity in an era of rapid change.” This forward-thinking approach has garnered respect on an international scale, earning commendations for the Judiciary’s efforts.
However, Fulford also issued a caution regarding the balance between innovation and judicial integrity. He remarked that “innovation must always remain subordinate to due process, open justice, and judicial oversight,” emphasizing the core tenets that underpin the justice system.
Discussing public trust, Fulford acknowledged the Bar Association’s role in mediating between a public with high expectations and the often slow-moving legal process. He explained, “We practice law in a time when public confidence in institutions is tested not by a single controversy, but by the pace and complexity of change itself.” He recognized the tangible human costs of judicial delays, noting that “for the ordinary litigant, delay or inaccessibility is not an abstract concern, but a lived experience.”
In defining the Bar’s role amidst these challenges, he commented, “The Bar sees its role as a bridge, between public expectation and legal process, between urgency and fairness, between change and continuity.” This reflection on the Bar’s responsibilities highlights the ongoing dialogue between legal professionals and the community they serve.
As he looked to the future, Fulford concluded with a commitment to stability and collaboration. “As we look ahead to 2026, the Bar does so with a commitment to steadiness rather than haste, refinement rather than division, and cooperation rather than conflict.” He reaffirmed the Bar’s commitment to work constructively with all stakeholders, including the Attorney General and the Director of Public Prosecutions, in a spirit of service that underpins the judiciary’s integrity.
