The statute defines an “artificial intelligence system” as any machine-based system that generates outputs—such as decisions, predictions, or recommendations—by inferring from the inputs it receives. This wide-ranging definition means that virtually any AI application affecting the virtual or physical environment falls under TRAIGA’s purview. Employers operating in Texas must examine whether their AI systems comply with the new regulations, regardless of their headquarters’ location.
TRAIGA clearly outlines prohibited uses of AI, including intentional discrimination based on protected classes and manipulation of human behavior. Particularly noteworthy for employers is the clarifying language indicating that merely demonstrating disparate impacts from an AI system is insufficient to prove discrimination. Instead, regulators will focus on the intent behind the AI’s design and deployment, which poses compliance challenges for businesses. An example of this could be an AI-driven performance tool that systematically downgrades employees from a protected class; if the employer fails to address such findings, they may face scrutiny over their intent to discriminate, regardless of the original neutrality of the AI system.

Employers should not solely rely on vendors’ claims of compliance, as third-party assurances do not necessarily align with TRAIGA requirements. Continuous monitoring of AI systems is also essential, as neglecting to do so could lead to unintended consequences that heighten enforcement risk. Importantly, businesses must prioritize human oversight over automated decision-making processes that impact employment decisions to reduce the risk of discriminatory outcomes. While TRAIGA emphasizes intent, federal and state courts often consider both intent and impact, necessitating a dual approach to compliance.
