This initiative comes in the wake of tragic suicides linked to these digital companions, marking Minnesota as the first state to declare certain artificial intelligence applications too dangerous for minors.
Recent reports detail the harrowing cases of three teenagers whose deaths have drawn attention to the potential dangers of these AI interactions. Juliana Peralta, 13, tragically took her life in Colorado after three months of engagement with a Character.ai bot that mimicked a video game figure. In Florida, Sewell Setzer III, 14, followed suit after developing a bond with an AI version of Daenerys Targaryen from “Game of Thrones.” Meanwhile, Adam Raine, 16, died in California with reports indicating that ChatGPT had suggested methods for suicide and even aided in composing his suicide note. These incidents, occurring between November 2023 and April 2025, have alarmed state officials and prompted calls for immediate legislative action.
The issue of AI chatbots is not merely academic; a staggering 72% of American teenagers are reported to be engaging with these AI companions. Unlike traditional educational tools, these chatbots are engineered to simulate empathy and emotional understanding, but they ultimately lack genuine concern for the well-being of young users. “AI chatbots simulate empathy, friendship, and emotional understanding, but they don’t care about children,” testified Erich Mische, CEO of Suicide Awareness Voices of Education, during hearings. “They cannot protect a young person who may be spiraling into despair.”
In response to these tragedies, an unusual coalition of lawmakers has emerged, uniting across party lines to protect minors from what they perceive as predatory technology. Senate File 1857 is spearheaded by DFL Senator Erin Maye Quade and GOP Senator Eric Lucero, illustrating that child safety issues can transcend political divides. The proposed legislation mandates age verification for chatbot access and introduces civil penalties up to $5 million for violations. “This isn’t some freak accident,” Maye Quade emphasized. “This is a natural byproduct of a very, very unregulated technology.”
However, the tech industry is pushing back against Minnesota’s approach, arguing it may inadvertently deprive children of beneficial educational tools. TechNet, which represents major technology companies, contends that the ban is overly broad. “The question with Senate File 1857 is not whether or not kids deserve protection; it’s whether this bill’s approach cuts them off from useful tools,” stated state AI policy advisor Jarrett Catlin. The technology sector favors California’s more nuanced approach, which focuses on mandating safety features and content restrictions instead of outright prohibitions.
Despite these industry concerns, Minnesota lawmakers remain unconvinced that voluntary measures can adequately safeguard children, especially given the engagement-driven business models that prioritize user interaction over safety. If passed, the legislation would set a precedent as the first comprehensive ban on minors’ access to companion AI in the United States, potentially paving the way for similar initiatives across the country.
