xAI Files Federal Lawsuit Against Colorado to Block Controversial AI Regulation

xAI files a federal lawsuit against Colorado to block a law mandating AI risk disclosures, claiming it infringes on First Amendment rights and alters its chatbot Grok.

Elon Musk’s artificial intelligence company, xAI, has filed a federal lawsuit seeking to block the enforcement of a new Colorado law regulating high-risk AI systems, set to take effect on June 30. The lawsuit, filed in court on Thursday, challenges Colorado Senate Bill 24-205, which mandates developers of AI systems to disclose potential risks and implement measures to prevent algorithmic discrimination in critical areas such as employment, housing, healthcare, education, and financial services.

The complaint argues that the law would compel developers to modify their AI systems, potentially restricting how models generate responses. Attorneys for xAI contend that “SB24-205 is decidedly not an anti-discrimination law. It is instead an effort to embed the State’s preferred views into the very fabric of AI systems.” They maintain that the provisions of the bill would inhibit developers from producing outputs that the state disapproves of, effectively enforcing a state-determined orthodoxy on contentious public issues.

The lawsuit calls for a federal court to declare the law unconstitutional, asserting that it violates the First Amendment by forcing changes to xAI’s chatbot, Grok, to align with the state’s perspectives on diversity and equity. The firm argues that SB24-205 improperly extends its regulatory reach beyond Colorado, is too vague for fair enforcement, and favors AI systems that promote “diversity” while penalizing those that do not align with these views. “By requiring ‘developers’ and ‘deployers’ to differentiate between discrimination that Colorado disfavors and discrimination that Colorado favors, SB24-205 compels Plaintiff xAI—a ‘developer’ under the law—to alter Grok,” the lawsuit states.

This legal challenge emerges amid a growing debate over the regulation of artificial intelligence, with several states, including Colorado, New York, and California, proposing regulations addressing the risks associated with generative AI tools. Concurrently, the federal government, under the Trump administration, is working to establish a national AI regulatory framework, intensifying the tension between technology firms and government officials regarding the oversight of AI technologies.

The lawsuit also arrives against a backdrop of increasing scrutiny directed at xAI’s chatbot Grok. In 2026, multiple lawsuits were filed accusing the company of permitting Grok to generate non-consensual deepfake images. A class-action complaint from three minors in Tennessee alleged that Grok produced explicit images of them without their consent. Similarly, the city of Baltimore has sued xAI, claiming that Grok generated up to 3 million sexualized images in a short span, including thousands featuring minors.

xAI has not yet responded to requests for comment regarding this lawsuit. As the conflict over AI regulation unfolds, the implications of the case may set a significant precedent for how states and the federal government approach the governance of artificial intelligence systems and their development.
