Elon Musk is currently embroiled in a legal battle against OpenAI, its CEO Sam Altman, and President Greg Brockman. The lawsuit, initiated by Musk, alleges that OpenAI has deceived him and strayed from its original mission as a nonprofit organization. Musk took to his social media platform, X, to express his grievances, stating, “Scam Altman and Greg Stockman stole a charity. Full stop.”
The focus now shifts from Musk’s social media rhetoric to the nine jurors selected on Monday, who will hear the case. Musk may take the stand as early as Tuesday, arguing that OpenAI betrayed its founding principles when it transitioned to a for-profit subsidiary. The jury’s verdict will guide Judge Yvonne Gonzalez Rogers in her decision on Musk’s requests, which include reverting OpenAI back to a nonprofit structure, removing Altman and Brockman from its board, and awarding approximately $130 billion in damages to fund OpenAI’s nonprofit initiatives.
This trial poses significant implications for one of the world’s leading AI companies and a key rival to Musk’s own AI venture, xAI, as OpenAI gears up for a potential initial public offering (IPO) later this year. OpenAI has countered Musk’s claims, suggesting that they stem from jealousy and regret over his departure from the organization.
The legal confrontation between Musk and Altman could have far-reaching effects on the future landscape of artificial intelligence. OpenAI’s anticipated IPO could prove to be a major milestone, allowing the company to leverage its early lead in the industry. However, a favorable ruling for Musk could hinder OpenAI’s progress and potentially bolster xAI’s position in the market.
Musk faces notable challenges in his lawsuit. During the jury selection process, several potential jurors were dismissed for expressing negative opinions about him, including one who described Musk as “greedy” and “a piece of garbage.” Judge Rogers acknowledged the public sentiment toward Musk, reiterating the importance of maintaining integrity within the judicial process.
While jurors had limited opinions on Altman, who was present during the jury selection, most exhibited neutrality toward both Musk and AI in general. This suggests a potential advantage for Musk as the trial progresses.
Musk co-founded OpenAI in 2015, contributing at least $44 million in its initial years. However, he departed from the organization in 2018 following a power struggle. A year later, OpenAI transitioned to a for-profit subsidiary to secure additional funding, eventually becoming a for-profit public benefit corporation in 2025. Musk argues that this shift represents a betrayal of OpenAI’s original mission to develop safe, open-source AI for public benefit, claiming that its leaders have wrongfully profited from his charitable contributions.
Microsoft has also been named as a co-defendant in the case, accused of facilitating OpenAI’s alleged breach of charitable trust. In a motion to dismiss, Microsoft labeled Musk’s claims as lacking factual specificity and reliant on unsupported assertions.
OpenAI contends that Musk himself advocated for a for-profit structure and departed from the company due to his inability to gain complete control. The organization characterized Musk’s lawsuit as motivated by jealousy and a desire to undermine a competing AI firm.
Evidence presented in the case includes hundreds of pages of emails, texts, call logs, and documents, providing an inside perspective on Musk’s interactions with OpenAI before and after his exit. These communications often reveal a stark contrast to Musk’s public statements on social media.
In one notable email from 2023, Altman referred to Musk as his “hero,” expressing hurt feelings over Musk’s criticisms of OpenAI. Musk’s response underscored the gravity of the situation: “I hear you and it is certainly not my intention to be hurtful, for which I apologize, but the fate of civilization is at stake.”
The outcome of this lawsuit could influence not only the trajectories of Musk’s and OpenAI’s respective ventures but also the broader AI landscape, where competition and collaboration continue to evolve rapidly.
