While the technology offers the allure of quickly generating polished and comprehensive documents at no additional cost, the legal implications are significant, raising concerns over malpractice risks.
Recent surveys indicate that approximately 10% of U.S. healthcare providers regularly utilize ChatGPT, while up to 40% employ various forms of clinical AI daily for tasks such as scheduling and medical documentation. Despite its ability to produce coherent text, AI lacks the capacity to practice medicine or law, a distinction that carries serious legal consequences under Florida law.
AI-generated consent forms often have a veneer of compliance but fail to meet legal requirements, creating a gap that can lead to professional liability. This phenomenon, known in AI terminology as a “hallucination,” refers to the generation of confident yet factually inaccurate content. AI systems like ChatGPT do not pull verified legal or medical data; instead, they produce probabilistic text derived from training data that may be of varying quality and recency. As a result, these forms can omit crucial procedure-specific risk disclosures and fail to identify medically acceptable alternatives specific to individual patients.

To date, no Florida court has acknowledged that using generative AI for consent documentation fulfills this standard. During litigation, a plaintiff’s expert could reasonably argue that no adequately cautious physician would delegate such a critical task to a text-generating tool that lacks clinical training and patient-specific knowledge. The legal adequacy of AI-generated consent forms remains a question for juries to decide.
This observation is not a blanket condemnation of artificial intelligence in healthcare. AI has proven useful in administrative and analytical functions such as scheduling, billing reconciliation, and clinical summarization. However, when it comes to consent forms, which serve as legal instruments, the stakes are high. The statutory defense against liability hinges on the proper execution of these documents, a defense that is forfeited if the forms are produced by a system devoid of patient-specific understanding and clinical context.
AI may well be used to generate templates for consent forms, but these must undergo thorough review, individualization, and validation by qualified professionals before application in any patient interaction. The law necessitates more than merely fluent language; it demands the human engagement that is essential for informed medical consent. In this respect, while AI can serve as a tool, it should never be regarded as a replacement for the critical human elements intrinsic to medical practice.
